The most critical elections in 2024 for Reproductive Freedom and our curated slate to support them, in partnership with Oath.
The Hummingbird Project’s 2024 Reproductive Freedom Election Map is a comprehensive overview of both the Presidential Battleground elections and the critical states where the outcome will have significant implications for abortion rights. Below is an outline of the essential battlegrounds for reproductive freedom and why.
To donate to the most critical races across this map, we have partnered with Oath to make it easy to support down ballot elections and ballot measures based on the most high impact investments your dollars can make an any given time throughout the election cycle. Below is a breakdown of each state and its significance as related to protecting, advancing or winning reproductive freedom (and also democracy!) in November.
Arizona
Importance: Arizona is a key Presidential and Abortion battleground with multiple critical races.
Key Races:
Abortion Ballot Measure: A measure on the ballot to ensure abortion rights.
State Legislature: Democrats only need to flip one seat in each State Senate and House and ensure trifecta for Governor Hobbs
US Senate: Replacing Kyrsten Sinema with Ruben Gallego, who supports abortion rights.
House Races: Flipping AZ-1 and AZ-6 from red to blue.
State Supreme Court: Remove anti-abortion judges in retention elections who upheld and egregious abortion ban from the 1800’s,
Presidential Battleground: Electing VP Harris with Arizona’s 11 Electoral Votes.
Montana
Importance: Retain and secure better abortion protections and maintain Senate majority.
Key Races:
Abortion Ballot Measure: Protecting and potentially expanding abortion rights.
U.S. Senate: Re-electing Jon Tester, a pro-choice advocate.
House Race: Flipping a key House seat.
State Supreme Court: Elect 2 progressive judges to the State Supreme Court to maintain a critical pro-choice majority, which is a backstop to the legislature and governor trying to ban abortion.
North Carolina
Importance: Protecting limited abortion rights in a highly competitive environment.
Key Races:
State Legislature: Eradicating the Republican supermajority.
Governor: Electing Democrat Josh Stein to protect abortion rights.
Attorney General: Elect to ensuring legal protection against anti-abortion laws.
Strategic Goals: Preventing further restrictions and maintaining a Democratic presence to counteract GOP dominance, NC is also a Presidential battleground.
Florida
Importance: Critical for removing current 6 week abortion ban.
Key Races:
Abortion Ballot Measure: Removing existing bans.
US Senate: Flipping a Senate seat (Congresswoman Debbie Murcasel-Powell vs incumbent Rick Scott who only has a 2pt lead as of June 13th: poll here.)
Presidential: Florida is now a key focus for the Harris campaign.
Nevada
Importance: Defending and advancing more reproductive rights protections and maintaining Democratic Senate majority.
Key Races:
Abortion Ballot Measure: Introducing more progressive protections than current law.
State Legislature: Protecting the Democratic majority (Governor of Nevada is Republican).
US Senate: Re-electing Jacky Rosen.
House Races: Defending 3 frontline House seats.
Presidential: Ensuring Nevada remains a stronghold for abortion rights with its 6 Electoral Votes.
California
Importance: California is crucial for gaining Democratic control in the House of Representatives .
Key Races:
US House: Six extremely competitive House races (CA-13, CA-22, CA-47, CA-45, CA-4, CA-27).
Presidential: Ensuring that VP Harris is relected with strong support from California and maintaining Democratic control of the House.
Michigan
Importance: Advancing and protecting reproductive rights in a pivotal swing state that has only recently gained these rights.
Key Races:
State House: Gaining on a slight Democratic majority.
State Supreme Court: Protect the progressive majority on the bench.
US Senate: Electing Congresswoman Elissa Slotkin to an open seat.
Strategic Goals: Ensuring Michigan’s 11 Electoral Votes go to a pro-choice president and securing progressive legislative power, MI is a Presidential Battleground.
Texas
Importance: Long-term focus on shifting the political landscape.
Key Races:
State Legislature: A long-term strategy to gain control over multiple election cycles.
US Senate: A outside shot of flipping a Senate seat (Colin Allred v. Ted Cruz).
Strategic Goals: The population of Texas is impacted the most out of any other state by abortion restrictions, so constant progress in Texas is critical. Registering 500,000 unregistered Democrats and laying the groundwork for future victories.
EXTRA CREDIT STATES (states on the map but Hummingbird activism not likely focused around)
New Hampshire
Importance: Protecting and potentially expanding abortion rights.
Key Races:
Governor: Flip the Governor’s seat.
State Legislature: Flipping the House (only 1 of two flip opportunities this cycle, the other is Arizona).
Strategic Goals: Ensuring abortion protections remain in place and potentially expanding them.
New York
Importance: New York plays a significant role in maintaining Democratic control in the House.
Key Races:
US House: Several competitive House races that need to be defended or flipped to maintain control.
Strategic Goals: Maximizing voter turnout and ensuring strong support for reproductive rights candidates.
These states represent pivotal battlegrounds where the fight for reproductive rights will play out in 2024. Their outcomes will have significant implications for the future of abortion access and broader reproductive freedoms in the United States.
The Importance of State Elections and Focusing Down Ballot:
While all of the major reproductive rights groups have federal candidate slates and focus, and will continue working with Senate leadership to push forward federal protection, at this moment, the fight for reproductive freedom lies in the States. That’s where we can make the most impact every election and make it lasting.
Here's a concise summary of the roles each state’s office plays in defending or eradicating abortion rights:
Governors
Governors can influence abortion rights through executive orders, vetoes or approvals of state legislation, and appointing judges to state courts who may rule on abortion-related cases.
Attorney Generals
State Attorneys General defend or challenge abortion laws in court, issue legal opinions that can shape state policy on abortion, and enforce or oppose regulations impacting abortion providers.
State Legislatures
State Legislatures pass laws that can either protect or restrict abortion access, ranging from enacting abortion bans to creating protections and funding for reproductive health services.
State Supreme Courts
State Supreme Courts interpret state constitutions and laws, making pivotal decisions on the legality of abortion restrictions or protections, and can uphold or strike down abortion-related legislation.
